U.S. District Court Judge John Sedwick struck down Arizona's gay marriage ban on Friday and declined to issue a stay of his ruling, saying "it is clear" an appeal would not succeed.
The Arizona Republic reported Thursday that the state's attorney general, Tom Horne, had already said he believed the 9th Circuit Court of Appeals ruling striking down similar marriage bans applied to Arizona, but wanted the judge to wait for a technical document from the 9th Circuit known as a mandate that directs courts to go forward with its opinion.
The number of states prohibiting same-sex marriage was expected to drop considerably following the Supreme Court's refusal to take up appeals on the issue earlier this month, and expectations have been fulfilled.
Horne has scheduled a news conference for Friday morning to address the decision.
Aaron Nash, speaking on behalf of the Maricopa County clerk's office, told the Arizona Republic clerks will wait for direction from Horne before they issue any marriage licenses.
